Booking, payment, cancellation and terms for Planète Dauphins excursions.

These General Terms and Conditions of Sale (CGV) govern the bookings and the sale of the sea excursion services offered by the company Nature Kayaks et Découvertes ("Planète Dauphins"). Any booking implies full and complete acceptance of these CGV.
These CGV define the conditions under which Planète Dauphins offers its sea outing services (dolphin and sea turtle watching, snorkelling, discovery of the Caribbean coast) departing from Anse à l'Âne, in Les Trois-Îlets.
Excursions are offered as half-days (morning or afternoon slot). The services, their duration and their content are described on the site's booking pages. Outings take place in a natural environment: the observation of wild animals cannot be guaranteed.
Booking is made online via the site's form, or by telephone. It is confirmed after validation of availability and, where applicable, of payment. The customer undertakes to provide accurate information (name, contact details, number of participants, desired date and slot).
Prices are shown in euros, all taxes included (TTC). They are per person, according to the rate in force on the day of booking. Planète Dauphins reserves the right to change its rates at any time, it being understood that services are invoiced on the basis of the rate in force at the time of booking.
Online bookings are paid by credit card : payment is secured and banking details are processed by the payment provider, without being stored by Planète Dauphins. Both credit cards Chèques-Vacances ANCV and cash are accepted at the time of the outing.
The customer may cancel or amend their booking free of charge up to 48 hours before the scheduled departure time. Any cancellation made less than 48 hours before departure, or any failure to show up at departure ("no-show"), may give rise to the invoicing of the entire service.
Passenger safety takes precedence in all circumstances. In the event of unfavourable weather or sea conditions, or for any safety reason, the skipper may have to cancel, cut short or postpone an outing. In this case, the customer is offered a rescheduling to another date or a full refund of the service. No other compensation may be claimed.
The customer undertakes to arrive at the meeting point at the stated time, to comply with the crew's safety instructions and to adopt behaviour respectful of wildlife and the environment, in accordance with the marine mammal approach charter. Minors remain under the responsibility of their parents or accompanying adults. The crew reserves the right to refuse boarding to any person whose condition or behaviour would compromise the safety of the outing, without refund.
In accordance with Article L221-28 3° of the French Consumer Code (Code de la consommation), the right of withdrawal does not apply to leisure services provided on a specific date or with a specific frequency. Excursion bookings therefore do not benefit from the 14-day withdrawal period; only the cancellation conditions set out in Article 6 apply.
Planète Dauphins implements the means necessary for the proper performance of its services, within the framework of an obligation of means (obligation de moyens). It cannot be held liable in the event of force majeure or of an unforeseeable and insurmountable act of a third party, nor for the consequences of the customer's failure to comply with the safety instructions.
The company has taken out professional civil liability insurance (responsabilité civile professionnelle) with Trans Mar (contract no. 1232054), covering its sea excursion activity.
Any complaint may be sent to 06 96 78 95 15 — reservation@planetedauphins.com. Failing an amicable resolution within two months, the consumer customer may refer the matter free of charge to the consumer mediator to which the company is subject: MTV — Tourism and Travel Mediation, BP 80 303, 75823 Paris Cedex 17 — www.mtv.travel. The customer may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
These CGV are subject to French law. In the event of a dispute not resolved amicably, jurisdiction is granted to the courts within the jurisdiction of Fort-de-France.
