Regulatory framework
The charter of marine mammals
Beyond tour operators offering cetacean observation, all sea users are invited to respect the rules of this charter to minimize disturbance to the animals and enjoy the show in good harmony with professionals. This brochure presents the main recommendations of the charter.
The decree of July 1st, 2011, establishing the list of protected marine mammals on national territory, also specifies the modalities of their protection by prohibiting any behavior likely to harm, disturb, disrupt, capture, harass or kill marine mammals, as well as to damage their habitats
Regulatory framework continued
The prefectural order 2013-065-0007 regulating nautical activities along the coast of Martinique, Guadeloupe, and the communities of Saint-Barthélemy and Saint-Martin specifies the minimum modalities to be respected for the approach of marine mammals. Non-compliance with these requirements may lead to legal action, with checks by state services regularly carried out.
